Although many businesses use background music supplied by professional companies that are specialized in the field of music selection, others may elect for a DIY solution and make reproductions of music from their CDs to copy onto iPods and other digital music players. Similarly DJs may want to make copies of their CDs either for making a back-up or for ease of transport to gigs etc.
The fair dealing provisions for format shifting in the Copyright Act do not extend to this type of use and licences are required from the relevant copyright owners.
If you also reproduce a sound recording of the song, you will need to obtain a further licence from the copyright owner in the sound recording. This is usually a record company. For further information on the licensing of sound recordings, contact Phonographic Performances New Zealand (PPNZ).
